These Terms and Conditions govern your access to and use of the website and member portal operated by Retro Motels Pty Ltd (ACN 700 480 011) trading as Retro Motel Collective ('RMC', 'we', 'us', 'our'). RMC is a commercial alliance of independent motels. We are not a franchise, not a booking site, and not a rate cartel. We act as a non-exclusive commercial agent for members to negotiate group terms with suppliers and platforms. Nothing on our website or portal is an offer capable of acceptance, and membership is governed by the separate Member Authority & Services Agreement.
You may use our website for lawful purposes only. Access to the member portal is restricted to members and authorised users. You must keep your login credentials secure and are responsible for activity that occurs under your account. You agree not to:
Membership and the services RMC provides are governed by the Member Authority & Services Agreement, the Schedule and the RMC Membership Tiers and Service Model document. Where there is any inconsistency between these Terms and the Member Authority & Services Agreement in relation to membership, the Member Authority & Services Agreement prevails. All content on the website and portal — including text, graphics, logos, the Retro Motel Collective name and branding, and software — is owned by or licensed to RMC and is protected by intellectual property laws. You may not use our trademarks or content without our prior written consent, except as reasonably necessary to use the services. Photography shown on the sample site is placeholder only.
Our website and portal may contain links to, or integrate with, third-party websites and services (such as suppliers, platforms and payment providers). We do not control and are not responsible for the content, terms or privacy practices of those third parties. Your dealings with them are governed by their own terms.
The website and portal are provided on an "as is" and "as available" basis. While we take reasonable care, we do not warrant that the website or portal will be uninterrupted, error-free or secure, or that information provided is complete or current. Any negotiated group arrangements are for the collective and may not be the best available terms for every individual member in every case.
To the maximum extent permitted by law, RMC is not liable for any indirect, incidental, special or consequential loss arising out of or in connection with your use of the website or portal. RMC is not a party to, and has no liability under, any contract formed between a member and a supplier, platform or guest. Nothing in these Terms excludes, restricts or modifies any rights or remedies you may have under the Australian Consumer Law that cannot lawfully be excluded.
We handle personal information in accordance with our Privacy Policy, which forms part of these Terms.
We may update these Terms from time to time. The current version will always be available on our website, with the "Last updated" date shown above. Your continued use of the website or portal after changes are posted constitutes acceptance of the updated Terms.
These Terms are governed by the laws of Queensland, Australia, and you submit to the non-exclusive jurisdiction of the courts of that State.
